Pot plants found; grower sentenced

"A 44-year-old Clinton man who was caught growing marijuana plants on his property recently pleaded guilty to a felony charge of manufacturing a controlled substance.Irvin Smith was arrested by narcotics deputies with the Island County Sheriff's Department Sept. 24, 1999, after they served a search warrant on his Midvale Road home.Island County Superior Court Judge Vicki Churchill sentenced Smith to three months in jail, the maximum sentence allowed, after he pleaded guilty to the charge Oct. 27. Churchill ruled that 30 days of the sentence can be converted to 240 hours of community service. In addition, she handed him a year of community supervision.According to the affidavit of probable cause written by Deputy Shawn Warwick, the detectives searched an outbuilding on Smith's property and found marijuana plants, a fluorescent light system, $545 in cash, a scale and five loaded guns. There was also another man in the building when they served the warrant.Smith arrived while the detectives were serving the warrants. He admitted that he also had pot plants growing in his house. The detectives found seven plants, three rifles and about 254 grams of bagged pot. "
