Man accused of stealing BB guns

A man allegedly attempted to steal three BB guns from the Tractor Supply Co. in Oak Harbor.

A man allegedly attempted to steal three BB guns from the Tractor Supply Co. in Oak Harbor and slapped a man in the face with a chain attached to a wallet, according to police documents.

A report by an officer with the Oak Harbor Police Department states that a Tractor Supply employee reported on July 3 that the suspect, later identified as 40-year-old Justin K. Smith, was attempting to steal the guns and a camo hat.

Another man in the store confronted Smith, who slapped him with a wallet chain and kicked an employee while fleeing the store.

Police responding to a 911 report on the incident found Smith attempting to hide in a dumpster, the report states.

After he was arrested, Smith admitted to trying to steal the guns but denied physically assaulting the employee or the man who confronted him, according to the police report.

The police documents state that Smith admitted to having a bag that contained methamphetamine. He then admitted that he was involved in a previous hit and run involving city property, where he was caught on surveillance video carrying two stolen generators from Harbor Freight to his car, the report states.

He allegedly sold the stolen generators for about $800 to fulfill his drug addiction, the police report states.

Prosecutors charged Smith in Island County Superior Court with assault in the third degree and theft in the third degree.

As of July 7, Smith was being held on $2,500 bail.
